Acceptance of Terms
By accessing or using the Mountains Are Magical website (mountainsaremagical.com), making an enquiry, or completing a booking with us, you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.
These Terms constitute a legally binding agreement between you ("the traveller" or "the client") and Mountains Are Magical ("we", "us", "our"), a travel services company registered in Jammu & Kashmir, India. If you do not agree with any part of these Terms, you must not use our website or services.
We reserve the right to update these Terms at any time. The current version is always available on this page, and continued use of our services following any update constitutes your acceptance of the revised Terms.
Booking & Confirmation
A booking request submitted through our website, via email, or over WhatsApp does not constitute a confirmed reservation. The booking process works as follows:
- You submit a booking request or enquiry with your desired tour, travel dates, group size, and any special requirements
- Our team reviews availability with hotels, transport providers, and local guides and sends you a detailed quotation within 24–48 hours
- Your booking is confirmed only after receipt of the required deposit (see Payment Terms below) and our issuance of a written confirmation email with a unique booking reference number
- Your confirmation email will include your itinerary summary, accommodation details, inclusions and exclusions, and any permit requirements specific to your destination
- It is your responsibility to review the confirmation details carefully and notify us of any discrepancies within 48 hours of receipt
Payment Terms
To secure your booking with Mountains Are Magical, the following payment schedule applies:
- Deposit (30%): A non-refundable deposit of 30% of the total tour value is required at the time of booking confirmation. This deposit secures your accommodation, vehicles, guides, and other services.
- Balance Payment: The remaining 70% of the total tour value is due no later than 14 days before your scheduled departure date. Failure to make the balance payment by this deadline may result in automatic cancellation of your booking, with the deposit forfeited.
- Last-Minute Bookings: For bookings made within 14 days of departure, the full tour amount is payable immediately upon confirmation.
Accepted Payment Methods
- Bank transfer (NEFT / RTGS / IMPS) to our designated company account
- UPI payment (PhonePe, Google Pay, Paytm) to our registered UPI ID
- Online payment via our secure payment gateway (Razorpay)
- International wire transfer for overseas clients (additional bank charges may apply)
All payments must be made in Indian Rupees (INR) unless a specific foreign-currency arrangement has been agreed in writing. Payment receipts will be issued for every transaction.
Pricing
- All prices displayed on our website and in quotations are in Indian Rupees (INR) and are inclusive of applicable GST unless explicitly stated otherwise
- Package prices are based on double or twin occupancy unless a single-room supplement is specified; solo travellers should request a solo-supplement quote
- Prices are valid at the time of quotation and are subject to change until a deposit is received and a booking confirmation is issued
- Group Discounts: Groups of 8 or more travellers may be eligible for customised group pricing — contact us for a tailored group quote
- Prices do not include airfare, train tickets, or other intercity transport to/from Kashmir unless specifically listed as inclusions in your package
- Any increase in government taxes, fuel surcharges, or permit fees after your booking confirmation may be passed on with advance notice
Travel Requirements
Travelling to Kashmir and certain high-altitude or border-adjacent areas involves specific documentation requirements. It is your responsibility to ensure you meet all requirements before your departure date:
- Valid ID / Passport: Indian nationals must carry a valid government-issued photo ID (Aadhaar, Voter ID, or Passport). Foreign nationals must carry a valid passport and any required Indian visa.
- Inner Line Permit (ILP): Travel to areas such as Gurez Valley, Lolab Valley, Shamsabari Range, and parts of Ladakh requires an Inner Line Permit issued by the Jammu & Kashmir government. We assist with ILP applications as part of your booking — allow at least 72 hours for processing.
- Wildlife Sanctuary & National Park Entry: Visits to Dachigam National Park and other protected areas require permits obtained in advance; we arrange these on your behalf.
- Travel Insurance: While not mandatory, comprehensive travel insurance covering medical emergencies, evacuation, trip cancellation, and personal liability is strongly recommended for all travellers to the region.
- Health & Fitness: High-altitude activities (trekking above 3,500m) require a reasonable level of physical fitness. Please disclose any medical conditions at the time of booking so we can tailor your itinerary safely.
Our Responsibilities
Mountains Are Magical is committed to delivering the experience described in your confirmed itinerary. Our responsibilities include:
- Providing accommodation, transport, guide services, and activities as specified in your confirmed itinerary and booking documents
- Substituting comparable or superior accommodation if your booked property becomes unavailable due to circumstances beyond our control, with prompt notification to you
- Informing you of any known changes to your itinerary as early as possible and working with you to find acceptable alternatives
- Modifying or rerouting your itinerary in the interest of safety due to adverse weather, road closures, security advisories, or other operational reasons — such changes do not entitle the client to a refund unless the service is wholly undeliverable
- Providing a 24/7 emergency contact number for all active tour groups travelling in Kashmir
Your Responsibilities
As a traveller with Mountains Are Magical, you agree to:
- Treat local communities, cultural sites, and natural environments with respect; Kashmir's landscapes and heritage are fragile — please leave no trace and follow Leave No Trace principles
- Dress modestly when visiting shrines, mosques, and villages in line with local customs and traditions
- Follow the instructions of your assigned guide at all times, particularly on trekking routes, water activities, and in areas with security restrictions
- Carry all required identification documents throughout your trip; checkpoints are common and lack of documentation can result in delays or denial of entry
- Not engage in any illegal activities, including photographing restricted military installations or areas designated as no-photography zones
- Inform us promptly of any changes to your group composition, health conditions, or requirements that may affect your itinerary
- Settle any personal expenses (laundry, room service, tips, shopping, extra meals) directly with the service provider; these are not included in package prices unless stated
Limitation of Liability
Mountains Are Magical acts as an organiser and coordinator of travel services provided by independent third parties (hotels, transport operators, guides). To the fullest extent permitted by applicable law:
- We are not liable for loss, injury, damage, or expense arising from circumstances beyond our reasonable control, including natural disasters, floods, landslides, avalanches, seismic activity, strikes, riots, government-imposed curfews or travel restrictions, border closures, or acts of terrorism
- Our total liability to you in connection with any booking shall not exceed the total value paid by you for that booking
- We are not responsible for personal injury, illness, loss, or damage arising from your own negligence or failure to follow safety instructions provided by our guides or accommodation providers
- We strongly advise all clients to purchase comprehensive travel insurance before departure to cover scenarios where we may have limited liability
Intellectual Property
All content published on mountainsaremagical.com — including text, photography, videos, itinerary documents, brand elements, logos, and graphic design — is the exclusive property of Mountains Are Magical or is used with the permission of the respective rights holders.
- You may not reproduce, distribute, republish, or commercially exploit any content from this website without our prior written consent
- Personal, non-commercial use (saving a page for your own reference) is permitted provided no modifications are made and copyright notices are retained
- Photography taken during your tour is for personal use only; use of our brand name or logo in any commercial context requires written approval
Governing Law
These Terms of Service are governed by and shall be construed in accordance with the laws of Jammu & Kashmir, India and the applicable laws of the Republic of India. Any dispute, controversy, or claim arising out of or relating to these Terms, or any breach thereof, shall be subject to the exclusive jurisdiction of the courts located in Srinagar, Jammu & Kashmir, India.
